1. OBJECT

These General Conditions of Sale exclusively govern commercial relations with our customers for the sales and services presented on the site www.decomotos.com and, more generally, are applicable to all commercial documents issued by our company. 

Prior to any transaction, the customer acknowledges having read the general conditions of sale and declares to accept them when he clicks on the "Validate" button of the virtual payment terminal, whether he pays by paypal, credit card, or by cheque.

USE
The products offered on this site are intended exclusively for people, companies, organizations, associations, communities, having a right to use a brand and its image.
Before ordering on this site, you must request a right of use from the owner of the brand.

If you use a brand's name or image without their consent, you risk a fine and a prison sentence. DECOMOTO declines all responsibility for requests for reproductions of copyrighted logos. The use of a logo assumes that its owner authorizes you to do so, and their use without authorization is under your sole responsibility.

The logos offered on the site are examples, if you are the owner of a logo present on this site, and you want it to no longer appear, send us an email to contact@linkmx.fr, we will remove it a.s.a.p.

Any order implies the prior consultation and acceptance of these General Conditions of Sale, which are accessible and printable at any time by a direct and permanent link on this site. 

It is understood that persons considered legally incapable of contracting within the meaning of articles 1123 and following of the Civil Code, in particular unemancipated minor children, must obtain the authorization of their legal representative prior to any order. 

DecoMotos reserves the right not to honor an order in the event of a legitimate reason as defined by the regulations (dispute relating to a previous order, abnormal request from the customer, computer problem).

3 - ORDER AND REGISTRATION

 

You can order your products either on our website or by telephone by contacting our customer service at 07 56 82 69 89.

To place an order on our site, you are not obliged. register in advance.
When ordering, a certain amount of personal information will be essential for the proper follow-up of your order, including an email address and a valid telephone number.
It is up to the customer to verify the accuracy of the data provided. Under no circumstances can DecoMotos be held responsible for delivery problems related to an error in the wording of your postal address.

Ordered :

To place your order, simply select the item of your choice and place it in your basket by clicking on the "Add to basket" button.

You can then continue shopping on the site and return, at any time, to your basket to modify it.

To validate your basket in order, you just have to click on the button "Order" accessible inside your basket. To At this stage, you will be able to view the different delivery methods and find out the applicable prices for your order. You can change your choice of delivery again after this step. The acceptance of your order will become final at the time of validation of your payment and once it has been accepted by your bank. A confirmation email will then be sent to you automatically to acknowledge receipt of your order. Note that once the order has been validated, the delivery addresses can no longer be modified on an order already in progress.

The order is considered "Accepted" from the moment the payment has been validated. We cannot guarantee the availability of items for orders where payment is pending (example deferred payment via PayPal)

 

Order modification or cancellation:

You can modify or cancel an order. For this, please contact our customer service at 07 56 82 69 89 within the hour following the order, by call or SMS.

4 - AVAILABILITYIT'S ARTICLES

Promotional items are available while stocks last.

The out of stock of an item cannot be defined as prejudicial damage giving rise to the right to any financial compensation.

In the case of an unavailable item, we will contact you by email as soon as we become aware of this shortage in order to offer you the refund of this item or if you wish the choice of another product.
(article L.121-20-3 of the consumer code).

In the case of an order with several articles, you can maintain the sending of the other articles without additional shipping costs and choose the refund only of the missing article.

 

5 - PRICES

The prices are indicated in euros all taxes included (TTC), excluding the flat-rate contribution to the shipping costs which is invoiced in addition (see article "Delivery" below). 
The VAT included is the French VAT in force on the day of the order.

The products remain the property of DecoMotos until full payment of the price. The prices applied are guaranteed. 

For any order placed outside the European Union, the total amount will be invoiced excluding tax.

 

6 - PAYMENT METHODS

BANK CARD (payment on order)

SHOW, EUROCARD MASTERCARD, Blue e-cards are accepted. In order to ensure payment security, confidential data (16-digit card number, expiry date, visual cryptogram) is transmitted encrypted (encoded) to Stripes' servers using the SSL security standard.

Secure payment : The payment method offered in e-transactions is SSL secure payment. This payment protocol is standard and recognized worldwide for the protection of data transmitted over the Internet. It is available on almost all browsers (Internet Explorer V3.02 and later from Microsoft, Navigator V1.1 and later from Netscape, etc.). 
The data provided by the Internet user on his card (number, expiry date, etc.) are encrypted before sending their post to the e-transactions payment server.

 

PAYPAL (cash on order)

If you choose deferred payment, your order will not be taken into account until the transfer is made to our account. PayPal.
This is a payment site that allows you to pay for your purchases with confidence. When paying, you will have a redirect link to the PayPal site. Thus, only PayPal will know your banking information.
For any order made outside metropolitan France, payment will be made automatically via PAYPAL.

7 - Returns 

7.1 - Items in stock are specified in the title by the keyword “stock”. All other items are custom printed on customer request. For all our custom-made or personalized products, the right of withdrawal does not apply, in accordance with the provisions of article L 121-20 of the Consumer Code as amended by LAW n ° 2014-344 of March 17, 2014 - art. 9 (V) which stipulates that the withdrawal period is 14 (fourteen) days, and withdrawal is notably excluded (article 121-20.2 3rd paragraph) for contracts for the supply of goods that are clearly personalized or made to the consumer's specifications, either in particular for made-to-measure, non-standard or personalized items. Thus, no withdrawal period will be granted for bespoke or personalized items, all non-standard items and items with specific additions or modifications (custom sticker, 100% personal, customizable, etc.).

7.2 Items in stock are specified in the title by the keyword “stock”. All other items are custom printed on customer request. The consumer has a withdrawal period of 14 days from receipt of the product (except made-to-measure items, see article 7.1). If the customer exercises his right of withdrawal, the DECOMOTO company undertakes to reimburse him the sums paid, less shipping costs, within a maximum period of 30 days, after actual receipt by our services of the goods concerned, in good condition and in their original packaging. The return costs remain entirely at your expense. The consumer can also choose to exchange the product.

SECURITY OF TRANSACTIONS ON OUR SITE :

In order to strengthen the level of security related to financial transactions carried out on the website and to protect decomotos.com and its customers against fraud attempts, the data collected by decomotos.com with its customers in the context of an order are likely to be communicated to its partner Stripes for the purposes of analysis and assessment of a level of confidence linked to each order.

Stripes will keep the data collected in this way for the purpose of enriching and managing its order analysis system. Furthermore, the occurrence of an outstanding payment on the grounds of fraudulent use of a means of payment will lead to the registration of the contact details relating to your order associated with this outstanding payment in a payment incident file artwork by Stripes. An irregular declaration or an anomaly may also be subject to specific processing.

In accordance with the modified law n°78-17 of January 6, 1978, relating to data processing, files and freedoms, you have at any time a right of access, rectification or opposition that you can exercise. at any time with Stripes in its capacity as controller.

In order to verify the authenticity of the buyer and to protect him against identity theft and fraudulent use of stolen credit card numbers, the Stripes company with which we work may ask you for proof of identity and home by email when placing a first order or by telephone.

Once your payment has been accepted, the status of your order may then be temporarily displayed as "checking stripes in progress" while Stripes carries out its analysis, which usually only takes a few hours (except in the case of a request supporting documents, in which case the order will remain on hold while the said supporting documents are received and verified).

DecoMotos reserves the right to refuse any order that has not been validated by Stripes which has not received the supporting documents in accordance with the request or when contact details are recorded as being fraudulent.

The order will then change to "order refused" status and it will be refunded as soon as possible via the payment method used.
